Yes, this should not happen. This used to happen with old 2.3/2.5 releases in very rare instances for some people. But with 2.6 the query you've shown never occurs inside a lock. Are you sure upgrade procedure went through ok?

Also the error report should've included the line # where the query was executed, but no such line is present. This implies you have a partially completed upgrade or modified 2.6.X sources.
